4. Display Placement, Safety & Assumption of Risk

Customer acknowledges that Porch Pop installations include pumpkins, gourds, crates, planters, cornstalks, and/or other decorative materials placed on or around entrances, walkways, stairs, porches, and other areas of the property. These materials may shift, roll, tip, deteriorate, become wet, or otherwise create potential trip, slip, or fall hazards during the installation period.

Porch Pop will use reasonable care when designing and placing each installation and will make reasonable efforts to maintain clear access to doors, stairs, walkways, and other primary paths of travel at the time of installation. Customer is responsible for inspecting and monitoring the installation after completion and for maintaining a safe environment for employees, customers, guests, vendors, and other visitors to the property.

Customer agrees not to move, stack, reposition, or otherwise alter the installation in a manner that could create an unsafe condition. If any portion of the installation shifts, falls, deteriorates, becomes damaged, obstructs a walkway, or otherwise presents a potential hazard, Customer agrees to immediately move persons away from the affected area and contact Porch Pop.

To the fullest extent permitted by applicable law, Customer assumes the ordinary risks associated with the presence of the decorative installation on the property and agrees to release and hold harmless Porch Pop, its owner, employees, contractors, and agents from claims, damages, losses, or expenses arising from the installation or presence of the decorative materials, except to the extent caused by Porch Pop's negligence, gross negligence, willful misconduct, or other liability that cannot lawfully be waived.

Customer represents that it has authority to authorize installation at the property and is responsible for identifying any property-specific restrictions, accessibility requirements, fire-code requirements, HOA/property-management rules, or areas in which decorations may not be placed.

5. Installation Location Approval

Customer authorizes Porch Pop to install the display in the location agreed upon at the time of installation. Customer understands that commercial properties may be subject to accessibility, fire-code, building-management, landlord, HOA, insurance, or other requirements specific to the property. Customer is responsible for obtaining any required approvals and notifying Porch Pop of restricted areas before installation.

Porch Pop reserves the right to modify or refuse placement of any portion of an installation that Porch Pop reasonably believes could obstruct a doorway, required exit, accessible route, stairway, walkway, or other area necessary for safe pedestrian access.
